Should you Sue McDonalds?

Almost everyone is familiar with the McDonald’s coffee spill case. But there are many other reasons find to sue the fast food giant:

A California mother is suing McDonald’s to end the marketing of toys with Happy Meals. She says that the company’s combining toys with their (unhealthful) meals is impeding her efforts to give her kids a healthy, nutritious diet. The plaintiff, Monet Parham, has stated:

I am concerned about the health of my children and feel that McDonald’s should be a very limited part of their diet and their childhood experience,” Parham said. “But as other busy, working moms and dads know, we have to say ‘no’ to our young children so many times, and McDonald’s makes it that so much harder to do. I object to the fact that McDonald’s is getting into my kids’ heads without my permission and actually changing what my kids want to eat.

People have also filed numerous lawsuits blaming their obesity on McDonald’s. While these suits usually fail, a McDonald’s employee in Brazil won a $17,500 judgment in a Brazilian court because, he said, he was forced to sample the food, and that made him obese.

Finally, a man sued McDonald’s over the distribution of nude photos of his wife that were stored on a cell phone that he accidentally left in the restaurant. Philip Sherman, the plaintiff, said he had called the Fayette, Arkansas McDonald’s where he had left the phone and was promised that it would be stored safely until he could pick it up. Instead, someone downloaded the photos and posted them on the Internet along with McDonald’s slogans like “I’m lovin it.” The prankster(s) even included his wife’s name–stating that she was “hot as McDonald’s coffee”–and phone number, which led to numerous phone calls.

With so many possibilities, it would seem that you, too, can sue. But be forewarned: McDonald’s has plenty of money and lawyers. They’re not going to lose a lawsuit without a fight!

  1. My wife found a flyer in McDonald salad. I kept the receipt and salad with flyer. Also I took some pictures in the restaurant.Can I sue McDonald?

    • doubt it. a flyer in your salad, as absurd as it may be, can’t hurt you. unless you got a paper cut, then MAYBE you might be able to get a little bit. but i wouldn’t say you took pictures in the store because they have a policy stating that you can’t take pics. it should be listed somewhere in the lobby.

  2. a anger customer from my drive thru buusted into mcdonalds cursing and tormenting me …i am only 17 she was at least 30 years of age the lady came around the counter and threating me cursing and hollering my manger stood there and did nothing i didnt open my mouth at all when the lady was in my face fearful of my life i looked towards my manger for protection who again did nothing. i moved to the side feeling threatned the lady again bashed me with threats feeling her about to charge i quickly called my parents since i didnt have any protection there the lady then threatned me some more feeling my composure lack i felt like i had to protect myself i did not fight or engage i argument but was later fired can i sue?

    • I just found a glass shard or a shard of hard piece of plastic its tiny but i was drinking the new cherry berry chiller and it made me almost slice my toungue. Everyones saying i should sue or do something about it i dont know what to do i just dont want someone getting hurt. These fast food industries need to learn to be more careful i dont want them to think im lieing or anything thats why i dont think sueing will help but i do need advice.

  3. Found out that the McRib does not contain any ribmeat and is actually made from throw away parts of the animal. When I found out I almost threw up, I will never eat a McRib ever again. Can Mcdonalds be sued for false advertisement.

  4. I had a idea for some food that I had made and taken pictures of. I sent them a e-mail and my mom had told me to keep the e-mail and keep it un-open in case they took the idea. Well about 2 months later what do I see on the menu? The burger I made up. No anything nothing even warning/telling me about it. Can I sue for stealing my idea and giving me no credit or payment for making the idea?

I happen to live cattycorner and downwind of a McDonalds that does little to keep trash from blowing up their exit onto a public side road, across the street, up into my driveway and depositing in my yard…They also break the noise ordinances, with delivery times, vent cleaning, grease trap cleaning, etc, and for which I have had to have the police out numerous times to stop…They sometimes stop or shorten what they were doing, but as time goes by they do it again and again and again…The municiplatity is oviously not going to do anything about it…I lose sleep, have to constantly pick up their trash and even though I contacted the home office, and was made empty promises, it continues…I’m trying to keep a cool head, but this is growing old and I can’t get help from anybody…I contacted a lawyer, he contacted McDonalds at the location I mentioned and I never heard from him again…I think I can sue the McDonalds and maybe the people doing the work after hours, breaking the noise ordinances, waking me up, ruining my sleep pattern and driving me mad…Is there a lawyer that will help me anywhere out there, if I can do anything to stop it, before this escalates?

    • Suggestion:
      In your spare time, you should walk about collecting up each piece of garbage in your community. Such a task will require photo documentation as well as generating an invoice to McDonald’s requiring payment.

      Remember to take your time and analyze each piece of debris and add it to the daily log of items collected. How ever much time you spend is still quicker than McDonald’s is taking to address the issue.

      Personally I would bill at 25$/hour worked collecting, documenting, and time spent invoicing. You are not looking to be an employee of McDonald’s, but a contractor for them since they are otherwise not feeling motivated to correct the situation.

      Contact their corporate headquarters and ask for their address of Accounts Payable, to ensure your invoices reach the proper department. Depending on how fast the debris piles up, should determine if you mail them an invoice once a week, or twice a month. Either way, you have a well paid opportunity there. 🙂

      I know this only addresses one of your many concerns, but it is a starting point.

  6. I found a foreign object INSIDE one of my chicken nuggets. It’s thick, hard and off white colored. I threw up after finding this huge lump in my food. I took pictures of the object and everything. Do I have a lawsuit?

    • i once found a worm in my fish sandwich and all i got from them was a check for 50.00. if it didn’t harm you in any way, i don’t think its a lawsuit. but i would contact mcdonalds and let them know and ask for some kind of compensation from them and be stern about it. good luck!

  7. I recently went to McDonald’s and got a 20 piece an it was uncooked.. I ate some then realized they were soggy, brought them back and manager wrote an incident report and apologized. Soon after I threw up and the next day I felt like I had the flu. Do you think there is a lawsuit here?

    • yuk ! I went to wendys one time,and got a under cooked chicken sandwich. i was sick within a hr. flu like aches. poison food is hard to prove because may be from another food before. so i guess you would have to puk in a bag and get it checked out. if they were wrong you may have a case

Incident occurred between 3:30 – 3:45 pm friday jan 13, 2012 I ordered a Double Cheeseburger and small fries and specified 4 times and made it CLEAR with the food attendant (And she acknowledged) that I am deathly allergic (anaphylactic shock) to ketchup and to substitute with mayo or a non ketchup product. Also specified for a 5th time loud enough and at the direction to woman making the burger and she looked at me as if there was confirmation that I am deathly allergic to ketchup. I told the attendant and said I have seconds to live as I go into anaphylactic shock immediately from 1 tiny drop of ketchup. Once I got the order in my hands I asked her for a 6th time that there is no ketchup, not even a drop anywhere in this bag. She confirmed with confidence as she rolled her eyes there was none. I left the building with TRUST. Well guess what! I left Mcdonalds with my bag of food and went up the highway and put my mouth around the burger but didn’t bite because at the corner of my eye, I saw ketchup on the wrapper. I then opened the bun and saw enough ketchup to gross most people out into eating a cheese burger with that much sauce. Is this attempted murder? You can pull up security camera video and sound on this to prove what happened. This McDonalds location is 10 Ensley Dr, Moncton, NB. I was wearing a Green woven wool jacket, military style adidas cap with custom embroidered lettering written on one side and the adidas logo on the other side, black jeans with white stitching. Eye-brow ring and piercing in both ears. Marydean Basque was the manager that came out to talk to me after I nervously drove back to the Mcdonalds. I really did try to keep my cool with the girl that served me the tainted burger as she refunded my money. I don’t think I even got an apology from her. I keep thinking this was attempted murder? I was deathly afraid for my life and physically shaking. I almost died purchasing a $4.00 meal! I was offered coupons from Mary-dean Basque for what happened but I am afraid for my life to eat at another Mcdonalds restaurant so had to refuse and go higher up on her authority. No empathy at all from anybody that I dealt with. This is somebodies LIFE they are playing with. I want financial restitution for playing with my life, not a coupon for a free meal. Does Mcdonalds really train properly? Are deadly allergic reactions to food not considered a high priority? Is this sue-able?

    • In all honesty, you are either lying about being deathly allergic to ketchup, or a complete idiot for biting something that could kill you without looking. Either way, you have zero chance of suing this restaurant as YOU did not take precautionary measures to ensure the food did not contain ketchup. It is not a foreign substance and you should probably just quit eating fast food in general.

  9. WOW ! If i knew this stuff was in my burger i would go to a place that makes fresh! Again big business putting profits before the feeding humans . yes they say we have to preserve , 100 % beef ? i have eaten at McDonald’s all my life ,its a safe place when your on the road. I think them taking ammonium hydroxide out of my burger ,makes me think that it shouldn’t be there. Well?! it shouldn’t , NO NO NO ! NOW I FEEL RIPPED OFF AND POISONED ! IF ANYONE WANT TO JOIN ME IN A CLASS ACTION SUIT . FEEDING ME POISION! ALL THESE YEARS. i THINK I NEED COMPENSATION.

  10. i am in the uk i cut my hand open on a macdonalds free coca cola at home while washing up. their was nothing wrong with the glass i think my hand broke it as the glass is thin i had four stitches but a few day later i had plastic surgery to sow my broken nerve 2gether it was one of my nerves to my right index finger and yes i am right handed can i do anything about it ..

    • That is crazy. I was washing a Coca Cola glass from McDonalds and it shattered on my hand. I had four laserations. Two of them required stiches (12). I was told to find out if anyone else has suffered injury due to defective glasses. I was trying to persue a case.

      • i have recently cut my hands on macdonalds glasses on three seperate occasions. one was quite bad but i didnt need stiches. THEY ARE VERY DANGEROUS

  11. I went to Mcdonalds in palmetto Ga I got my 4 year old son chicken nuggets and when he bit into one of them there was a worm inside. I want to file a lawsuit against them I still have the nugget and receipt and box. As a busy single mother I’m sick and tired of going and getting the wrong food sometimes I work so late that it’s the only place open where I can get them a meal my daughter with allergies always gets a hamburger no cheese no onions no mustard no pickle just meat and bun (plain I now) but everytime they give her the wrong burger and times I dont know till I get home and sometimes Iv traveled half an hour b4 reaching home and yet they can’t get through there heads 1 mistake can cost a child there life there lucky I’m a mum that checks the food but I’m sick of paying the petrol and the time to travel back out of my way to get the dam burger she wants when they get paid to do there friggen job right they should he paying me for the wasted hours and wasted miles on my car traveling back n forth all the friggen time I have had enough

  13. I had a sausage and egg mcmuffin and as I but into the last half of it something hurt my teeth and stuck in between them. I managed to get it out to discover it was a shard if glass I’ve kept the shard and the rest of the burger what can I do?

  14. Ive Been biking to work lately and been getting off around 11:30 PM. Every stinking time I go to this particular McDonalds a few blocks up the street from my house, I go into the drive-thru window and they always give a lame ass excuse as “We’re sorry but we cannot serve you.” I tell them that if they don’t want my green paper I will take it over to Wendy’s which is conveniently across the street from McDonalds. Im only getting 1 hamburger and thats all. Are they even aloud to do this especially when there is no one else in drive-thru? I find it funny that this particular location says it but not ay other ones I have been to. My own mom works for McDonald’s a few town over and said they always allow cyclists in the dive-thru no matter how late at night. Anyway I can sue them for being complete dick heads?

  15. I went to McDonald yesterday in order to buy some breakfast. I parked my car in McDonald parking lot, but before going to McDonald, I decided to drop off some books from the library which is locate just next door. Luckily for me, the library was closed so I turned around and headed to McDonald when this man stopped me from going inside and told me tha my car was being towed because it was ilegally parked. I have no other option than pay the tow driver since I needed my car to get to work. Can I sue McDonald for it? The whole incident took less than 3 minutes. Please help.

  16. I brought my food home and, as I was eating my McChicken, bit something hard and almost choked. I was able to cough it up and it was a bone of some sort. I wasn’t at the restaurant, but I still have the bone wrapped up and saved. Is it worth trying to get something for this?

  17. I am So Tired Of McDonald’s And The U.S Government because they don’t tell us what the company’s put in our food we Deserve better.. No Wonder we are called the Obese Country We all need to put a stop to fake food Its slowing our Everyday Life down no man no woman should be sold Crap for Awful High Prices.. What do you expect There is Eyeballs, Bones and other body parts in our chicken.. There is Corn syrup and and body parts in our beef we don’t know about.. They Should Be Sued For telling Us lies Saying “The Beef Is 100% Real, and the Chicken Is 100% Real and the fries are 100% Made from potatoes.. We all need to Stick together and fight for our rights and be Gurenteed That What we are eating is real.. No Matter If is Mcdonalds.. The WHOLE Fast Food Industry..

  18. I am a regular at a Mc Donalds in Catonsville Maryland. Some nights I go to this location after work around 9:30 pm. My boyfriend and I are always curtious “please and thankyou” ect. We were quite bothered by the evil/hatefull looks coming from one of there managers EVERYTIME WE GO IN THERE… There is a door that faces rt. 40 and it is the most convient door for me to leave out of. Other nights when she’s not there the other managers have “no problem letting me out this door” Well on this night she decided she was going to watch me eat through the employees only door and waite for us to finish… that’s enough to make me mad… I told my boyfriend that were going out that door tonight mostly because I felt I was being stalked/harrassed/ or discrimated against. So I filled my soda (like always) and came back to the table to collect my belonging and leave. While I was at the drink spot I could see that she was standing inside the door watching me… just before we stand up to leave she unlocks the door to let a customer in and says loudly “you have 10 minutes” now I’m not sure if she ment us to leave… or the door is unlocked or what… I assumed we had 10 minutes till she locked up the door, so we head for the door. She trys to tell me not to and I tell her no I’m not playing your game tonight. She proceeds to tell me I’m not allowed back and screams at me across the street to the point that I decide to call the cops… I WILL BE TAKING LEGAL ACTION. Oan not to mention I have reported EVER incident I have had in Mc Donalds

A different Manager called me today to let me know “she will take care of it” and to “come see us we miss you” I guess I waited too long because by the time I got there I was in the process of ordering and she told the cashier to not take my order. I have health conserns that’s require food/ sugar and when its low it makes me not be able to control my anger and my boyfriend is legally dissabled… she has no idea what she started with me.   20. McDonalds in Houston, Texas , located off S. Breaswood and Hilcroft. Almost killed my 5 year old son!!. I. Went through the drive thru and ordered a kids meal plain. I stated no onions, because my son was allergic. When we got the meal I checked it and found it had onions on it. in I gave it back so they could re-do the order, I waited 10 minutes and the. manager brought out the. Meal she apologized and said she brought it out to make sure it was”Right” I drove off assuming the. Order was. Correct,
    My son got home ate the burger and hollered for me I ran. Down stairs to see onions on his burger and him struggling to breathe I administered the epipen. I filed a complaint with the corporate office. Who gave me their insurance company’s number, filed a complaint with CNA insurance company, which sent me a letter stating it was my fault, that, I had the greater responsibility to not give my son the burger without checking it first and that their client McDonalds was not st fault ” So We are denying the claim” Wow!! parents McDonalds does not care about the health and safety of our children. They want our money but does not want the responsibility of making sure the food they serve our children are safe for them to eat.!;; I am in search of a lawyer to sue the establishment and will never be a consumer of anything related to McDonalds in anyway. Very shisty business ethics for a Restaurant that targets our kids!!;

    I am a long time customer of McDonald’s and I have moderate to severe allergies. I am allergic to gluten and meat because they made me sick. I am going to file a complaint to McDonald’s corporation that all McDonald’s should have gluten-free breads and soy patties. I am vegetarian since 17 yrs old in September 2009. Do I have to pay the lawsuit or do a lawsuit for free. I’m going to write a letter to McDonald corp. about not just having gluten and meat but varieties of gluten free breads and soy patties. I am on a special diet now. I was told by my doctors to be on a special healthy diets. I sometimes go to the doctors but not very much.

  23. I had my first day working at McDonald’s June 7th, 2013 and they put me on the fries vat. I put the basket of fries on the holding rack, which broke off and hot oil splashed all over me causing burns on my right arm. The manager said he knew it was broken and no one fixed it for months. Can I Sue?

  24. After ordering food at McDonalds, I began to eat my fries. I put my food out on a plate and found a fried roach as well as broken pieces of the insect all mixed in the fries. I don’t know if I ate any of the insect, that really troubles me. I have reported the situation to McDonalds corporate, the health dept., and I’ve contacted the local news. I was offered coupons as compensation, but I feel that will not suffice. I can’t imagine eating out, let alone, at McDonalds ever again, I work in a restaurant, and it has really hindered my ability to do my job. I am grossed out at the sight of food outside my home. I really don’t know what will make me feel better about the situation. I am seeking psychological help. My relationship with food will never be the same. I really need guidance on what other steps I can take. I am so frustrated.

  25. It was almost 2 years ago I ordered an ice cream sundae from mcdonalds. I took a bite and a huge chunk of white plastic met my tooth and chipped it. When I confronted the store they explained a piece of the machine must have broken off and into my sundae. Once I got in contact with the lady from their corporate office she stated to make a claim I had to pay upfront for the cost to fix my tooth. I didn’t have the money and soon after I was moving out of state to go to school. I finally have an appt with a dentist but the lady after I told her I couldn’t afford to pay it up front stopped returning my calls. My tooth still bothers me to this day. Do I have a case or am I just wasting my time?

  26. i went to McDonald this morning and ordered 10 sausage mcmuffins and large coffee, they gave me the coffee and told me pull up order be right out, after 10 min i reversed back to the window and told them if my food was still not ready i wanted a refund. the lady in the blue shirt told me she was not ****ing refunding 10 ****ing sandwiches, so i got made and started yelling she shut the window in a min or so she tried hand me the food i refused and demanded a refund she began yelling and i in return then she slammed the windows called someone then in a min or two was back at the window with my money but when i reached for it she jerked it back so i tried snatch it from here while her and other co workers was laughing then she threw it down the drive threw and told me fetch my money as i was getting back in my car i got sausage mcmuffins threw at me by a couple of the workers also pop and coffee threw in my face and all over in and out my car

  27. I bought a burger at McDonalds got home took a bite and saw it was way undercooked blood dripping from the meat. Sapped a few photos, took it back got a refund and a “sorry”, stomach pain and nausea for a day. Will never go to McDonalds again, I understand that all stores are not the same but not taking any more chances.

  28. my husband bit into a Big Mac and cracked all the teeth in the back left side of his mouth because there was a shard of metal that was lodged between the meat. we showed the McDonalds the Big Mac the metal piece what happened to my husband and the insurance company was very slow to get in contact with us so we contacted the lawyer and now they are only wanting to pay for the one time dental work. my husband is going to need a lot of surgeries in the future to keep his teeth in actual working condition considering how bad they are now. He just be cancer and all the chemotherapy he received lowered his immune system and weekend all his bones in an animal which led to the severity of the cracks in his teeth and him his teeth getting infected from how long its taking from them to get fixed because of how slow mcDonalds is about getting the repairs done for him. it’s over $5000 worth of damage that they can see should we sue for more we ask for 1 million they want to settle for 10000 to 20,000.
